1. Applicable Law
These terms and conditions are subject to the laws of England and Wales, and any disputes relating to them shall be resolved in the English courts.
2. Definitions
In these Terms and Conditions, "Fire Work Glass Studio," "us" or "we" shall refer to Fire Work Glass Studio located at Fire Work Glass Studio, Brushford, Diptford, Totnes. Devon. TQ9 7LU.
3. Ordering
All orders are subject to availability and we reserve the right to refuse to supply any goods to any customer. All orders placed through our website are subject to these Terms and Conditions.
4. Payment
Full payment of the order must be made at the time of ordering. We accept payment through all major credit cards, PayPal.
5. Delivery
Most items are "Made to order" so there will be a natural delay in dispatch. Items that are already made will be dispatched as soon as practicable. Please allow for slight delays during peak times. Delivery times may vary depending on the destination country. We will not be held responsible for any delay in delivery caused by circumstances beyond our control.
6. Returns
We accept returns within 14 days of receipt of the goods, provided that the goods are in their original condition and packaging. The customer is responsible for the cost of returning the goods. Refunds will be made within 14 days of receiving the returned goods.
7. Cancellation
We reserve the right to cancel any orders that have been placed in error or where we have been unable to fulfil the order due to circumstances beyond our control.
8. Your Consumer cancellation rights
In line with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, You have the right to cancel any order you have made with us on our website within 14 days, starting the day of receipt of the goods by yourself or the place where they have been delivered to. This can be done by sending us an email, letter, or giving us a call, notifying us of your intention to cancel. All our details are in the contacts section of our website. Exercising your right to cancel is deemed to have been made on the day you give us notice of cancellation in whatever form. We will confirm we have received your cancellation notice and of any subsequent actions to be taken where required.
This right does not extend to trade contracts or bespoke goods where we make your order to your specific requirements.
Following cancellation you will return the goods to us at your earliest convenience or within 14 days of starting from the day after we have confirmed we have received your cancellation notice. The cost of returning the goods is borne by you, the customer.
If you intend to cancel then you are required to keep the goods in the good condition you received them. Due to health and hygiene reasons you may lose your right to cancel if you open a product’s packaging. We also reserve the right to deduct an amount from any reimbursement if you have opened, used or in any way diminished the value of the goods by handling them beyond what is necessary to establish their nature, characteristics and function. What is deemed handling beyond necessary is decided on a case by case basis. Contact us if you have any questions relating to what could be deemed handling beyond necessary prior to your order.
We will then refund you the cost of goods paid at the time of your order, including delivery costs, not later than 14 days starting the day after we have received the goods back in our possession, or from the date you send us proof of postage or similar that the goods are on their way back to us. We will only refund standard delivery costs for the goods and not additional special delivery costs. We will notify you when we have received the goods back in our possession or confirm receipt of your return proof of postage. Any refunds due under this section or for any reason will be made using the same payment method that you used when ordering the Goods.
Your 14-day cancellation period is in addition to your statutory consumer rights, so any faulty or unsatisfactory products can be returned to us as soon as practicable. Please contact us as soon as you can if you feel you have received faulty or unsatisfactory products from us.
9. Liability
We shall not be liable for any loss or damage suffered by the customer as a result of any breach of our obligations arising under these Terms and Conditions.
10. Privacy
We are committed to protecting the privacy of our customers and any information we collect will be used in accordance with our Privacy Policy.
11. Amendments
We reserve the right to amend these Terms and Conditions without notice. Any changes to our Terms and Conditions will be published on our website.
